Relationship of apartment owners
We all know that buying an apartment is a difficult and responsible process. This is a rather serious step in a person's life, and everyone realizes the fact that this is one of the largest investments that you will make in your life. In order for the value of the real estate you have purchased to increase over time, it needs maintenance, and it is for this purpose that homeowners' associations are created.
Residents of a newly built building form a partnership and to resolve issues related to the common property of the apartment owners, they elect a chairman of the building as a contact person, who must be elected by the majority of the residents' votes. It is the chairman of the building who must hand over the works specified in the handover conditions performed by the development company (paved external facade, well-equipped yard, properly working elevator, orderly entrance, external lighting, and equipped garage).
The common property transferred by the company to the chairman needs maintenance:
- Security of the territory - installation of security cameras and hiring of a security guard or hiring a security service;
- Greening - maintenance of trees and plants planted in the courtyard of the residential complex;
- Parking - maintenance - cleaning;
- Elevator - hiring a service company, whose duty will be to repair it in case of damage and carry out other supervisory work, as well as the issue of intercom and chips, which is the company's obligation to resolve;
- Water pump - commissioning and maintenance;
- Outdoor lighting - commissioning and maintenance;
- Utility charges for common space - entrance, garage, and yard lighting.
Correct management of all the above points ensures the increase of the value of the residential complex and its development. Live in a clean, safe, and comfortable environment. It is the residents who can effectively resolve issues related to the maintenance and development of this common property.
Common property of the members of the cooperative association - The plot of land, which is the common property of the members of the cooperative, and those buildings, installations, engineering networks, devices, which are not individual property, are common property members of the cooperative association;
Partnership formation and election of the chairman - the activity of the apartment owners' partnership is led by the chairman of the apartment owners' partnership; - in multi-apartment housing, where the number of entrances exceeds two, the chairman of the cooperative association can appoint a representative at each entrance, whose functions are determined by the charter of the cooperative association.
Due to the need for effective decision-making, each entrance should have one representative, and one chairman can be chosen from this representation, as well as from other members of the partnership;
Functions of the chairman - the activities of the cooperative association are led by the chairman of the cooperative association, he may be elected from among the members of the cooperative association or be an invited manager;
Duties of the Chairman - to convene and chair the meeting of the members of the association; to take necessary measures to ensure proper maintenance and development of the common property in agreement with the meeting of the members of the association; to ensure the alienation, rental, lease, and mortgage of the common property of the members of the association in agreement with the meeting of the members of the association of homeowners; to ensure the hiring of appropriate service companies or individuals for the maintenance and development of the common property of the members of the association of homeowners and to conclude contracts with them; to determine the economic expenses for the current year in agreement with the meeting of the members of the association; to determine the expenses of the association of homeowners for the current economic year in agreement with the meeting of the members of the association of homeowners; Ensure compliance with construction, technical, fire prevention, sanitary and other rules and regulations for the common property of the members of the homeowners' association; comply with the requirements of the homeowners.
All the above measures are completed only based on a unanimous decision. The chairman can assume other obligations - only if they are written in advance in the charter adopted by the partnership. In the absence of the chairman or in case of his inability to perform his duties, one of the members of the cooperative association performs the duties of the chairman at his request;
Advantages of a homeowners' association - the opportunity to participate in municipal programs; solving common problems and/or developing and improving common property through co-financing; simplified relations with state structures and private legal entities or individuals; maintaining and increasing the market value of the property owned by the association and its members through regular maintenance activities; ensuring legal conditions for the management and development of common property of homeowners' association members; the opportunity to create a charter that determines the rights and obligations of the association members (in the absence of a charter, all actions are carried out in accordance with the provisions of the Law of Georgia on Homeowners' Associations).
The main task of a homeowners' association is the maintenance, operation and development of common property.
